Article 1 – Purpose
These Terms of Use (hereinafter "ToU") define the terms of access and use of the Portage AI website (hereinafter the "Site"), an umbrella employment platform fully automated by artificial intelligence, accessible at www.portagesalarial.ai.
Article 2 – Definitions

Article 3 – Site access
Access to the Site is free. Some features require creating an Account.
Portage AI reserves the right to suspend or restrict access to the Site for maintenance, updates or security reasons, without notice or compensation.
Article 4 – Account creation
Account creation is reserved for legally capable adults.
The User agrees to provide accurate, complete and up-to-date information and to keep it updated.
Warning : Any fraudulent access or misuse may result in immediate Account suspension without notice.
Article 5 – Automated operation by Artificial Intelligence
The User acknowledges and accepts that:
1. Automated decisions
Certain decisions are made by AI agents (income simulation, payroll calculations, alerts, compliance pre-checks, expense report validation).
2. AI limitations
These automated decisions do not replace personalized legal, tax or financial advice.
3. Human escalation
Complex, disputed cases or those exceeding defined thresholds are escalated to a human operator.
4. Transparency
The User may at any time request an explanation of automated decisions concerning them.
5. Supervision
A supervision system (AI Supervisor Agent) continuously monitors the proper functioning of AI agents.
Article 6 – User obligations
The User agrees to:
- Comply with applicable French legislation
- Not divert services from their intended purpose
- Not attempt to hinder the operation of the automated system
- Not impersonate a third party
- Not transmit viruses or malicious software
- Immediately report any unauthorized use of their Account
Article 7 – Intellectual property
The Site, its artificial intelligence algorithms, interfaces, databases, content and trademarks are protected by intellectual property law.
Any unauthorized reproduction, representation, modification or exploitation is strictly prohibited and constitutes infringement punishable under articles L.335-2 and following of the Intellectual Property Code.
Article 8 – Liability
Portage AI cannot be held liable for:
- Decisions made by the User based on AI simulations or recommendations
- Misuse of the platform
- Force majeure (network failure, cyberattack, natural disaster)
- Indirect or unforeseeable damages
- Errors or omissions in information provided by the User
Portage AI's liability is limited to direct and foreseeable damages resulting from a proven breach of its obligations.
Article 9 – Personal data (GDPR)
Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act.

Article 10 – Cookies
The Site uses cookies to improve user experience and measure audience. Users can set their preferences via the cookie banner or browser settings.
Article 11 – Modification of ToU
Portage AI reserves the right to modify these ToU at any time. Users will be notified by email and/or notification on the Site.
The applicable version is the one published on the Site at the date of consultation.
Article 12 – Applicable law and jurisdiction
These ToU are governed by French law.
In case of dispute, the parties agree to seek an amicable solution. Failing that, any dispute falls under the exclusive jurisdiction of French courts in the jurisdiction of Portage AI's registered office.
